  1. Scope

These Terms & Conditions apply to all orders placed through the OuraniaArt online shop.

OuraniaArt is operated as a small business under the Austrian small business VAT exemption. In accordance with the applicable Austrian VAT regulations, no VAT is charged or separately shown on invoices.

These Terms & Conditions apply to both consumers and businesses. Where applicable, mandatory consumer protection laws apply in addition to these Terms & Conditions.

  1. Products and offers

The products displayed in the OuraniaArt online shop, including T-shirts, stickers, postcards and other products, constitute an invitation to submit an order and do not in themselves constitute a legally binding offer by OuraniaArt.

Product images are provided for illustrative purposes. Due to different screen settings, colours may vary slightly from the actual product.

Minor variations may occur with printed, handmade or individually produced products, provided that these do not materially affect the agreed characteristics of the product.

  1. Orders and conclusion of the contract

By submitting an order through the online shop, you make a legally binding offer to purchase the selected products.

A purchase contract is only concluded once OuraniaArt expressly accepts your order, for example by sending an order confirmation by email.

An automatic confirmation that your order has been received does not by itself constitute acceptance of the order.

OuraniaArt reserves the right to decline an order before the purchase contract has been accepted, without having to provide a reason.

This may apply, for example, if a product is unavailable, if the requested order cannot be produced or fulfilled, or for other operational reasons.

If an order is declined, you will be informed accordingly. Any payments already made will be refunded in full.

  1. Custom products and special requests

In addition to the products regularly offered in the shop, OuraniaArt may offer individually designed products or other custom-made products upon request.

Whether a custom request can be fulfilled, as well as the price, production time and delivery time, will be agreed individually.

Custom products will only be produced after OuraniaArt has expressly confirmed the order.

If you provide images, designs, logos, text or other content for a custom product, you are responsible for ensuring that you have the necessary rights to use such content.

You must not provide content that infringes the intellectual property rights or other rights of third parties.

  1. Prices

All prices displayed in the OuraniaArt online shop are final prices.

As OuraniaArt operates under the Austrian small business VAT exemption, no VAT is charged or separately shown.

Shipping costs, if applicable, are added to the product price and will be displayed before the order is completed.

Custom-made products may be subject to individually agreed prices.

  1. Payment

Payment is currently offered by invoice.

The invoice amount must be paid within the payment period stated on the invoice.

In the event of late payment, OuraniaArt reserves the right to claim statutory interest and any legally recoverable costs.

  1. Shipping and delivery

OuraniaArt generally ships orders within the European Union.

Shipping to countries outside the EU may be available upon request and must be agreed with OuraniaArt before the order is placed.

Available shipping destinations and shipping costs will be communicated or displayed before the order is completed.

Estimated delivery times are stated where possible on the relevant product page or during the ordering process.

Delivery times may vary depending on the destination, availability and production time of the product.

If unexpected delays occur, OuraniaArt will inform you where reasonably possible.

For shipments outside the European Union, customs duties, import taxes, fees or other charges imposed by the destination country may apply. These costs are the responsibility of the customer.

  1. Retention of title

The goods remain the property of OuraniaArt until the purchase price has been paid in full.

  1. Copyright and intellectual property

All illustrations, designs, photographs, graphics, texts and other creative content created or provided by OuraniaArt are protected by copyright and other applicable intellectual property laws.

The purchase of a product does not transfer copyright or other intellectual property rights in the underlying design to the customer.

Unless expressly agreed otherwise, designs may not be reproduced, modified, distributed, commercially used, resold or transferred to other products without prior written permission from OuraniaArt.

This also applies to designs created individually at a customer's request unless different usage rights have been expressly agreed.

  1. Right of withdrawal

Consumers generally have a statutory right to withdraw from distance contracts within 14 days without giving a reason.

The details regarding the right of withdrawal, the withdrawal period, the procedure for exercising the right and the consequences of withdrawal are set out in the separate Right of Withdrawal / Cancellation Policy.

Statutory exceptions to the right of withdrawal remain unaffected.

  1. Returns

In the event of a valid withdrawal, the statutory rules regarding the return of goods and reimbursement apply.

The direct cost of returning the goods is borne by the customer, unless otherwise required by law or expressly agreed by OuraniaArt.

Statutory warranty rights remain unaffected.

  1. Warranty

Statutory warranty rights apply.

If a product is defective, customers are entitled to the rights provided by applicable law.

The statutory warranty rights are not excluded or restricted by these Terms & Conditions.

Normal wear and tear, damage caused by improper use or improper care, and other damage caused by the customer are not considered defects to the extent permitted by law.

  1. Damaged deliveries

If a parcel is visibly damaged upon delivery, customers are encouraged to document the damage and inform OuraniaArt as soon as possible.

This does not affect any statutory rights.

  1. Product availability

OuraniaArt makes every effort to keep the products displayed in the online shop available.

However, there is no guarantee that a particular product will always be available.

If a product unexpectedly becomes unavailable after an order has been submitted and the order therefore cannot be accepted, the customer will be informed and any payment already made will be refunded.

  1. Liability

OuraniaArt is liable in accordance with applicable statutory law.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by mandatory law.

  1. Privacy

Information regarding the processing of personal data is provided in the separate Privacy Policy.

  1. Applicable law

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

Where the customer is a consumer, this choice of law does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.

  1. Dispute resolution

OuraniaArt aims to resolve any complaints or disputes directly and amicably.

Consumers may contact the competent consumer dispute resolution bodies where the applicable legal requirements are met.

  1. Final provisions

The version of these Terms & Conditions applicable at the time the purchase contract is concluded shall apply to that order.

If any provision of these Terms & Conditions is or becomes invalid, the remaining provisions remain unaffected. The applicable statutory provisions shall apply in place of the invalid provision.
